McCain was born from two US citizens... he could have been born in USSR and would be born an American citizen due to *both* his parents being citizens.

Obama has written two books and has spoken openly of his parents. I am no immigration lawyer, but the question being asked is since Obama's father was not a US citizen... only one parent was then a citizen.. his mother.

According to what has been published she was 18 when he was born. So, here is what has been posted: That if a child is born to a parent who is *not* a US citizen, then the other parent *must* have resided in the US for at least the previous 5 years for the child to be born an American citizen. OK, supposedly... here the catch: The 5 years counts after the parent turns 16. So, the mother would then have to be 21 and as it has been publicly stated... she was 18.

That is what has been published on blogs abut the topic. As I have said I am no expert on immigration law. I have just read this elsewhere.

It would all go away so simply,*if* he would just make the record public.

You know the more we learn... the more I think McCain should maybe embrace the "McBush" tags. To be honest, I am kinda skittish of change right now. Bush III right now would be kind of comforting.:)

What are you talkign about? His mother is from Kansas. Also, even though your parent are citizens, in most cases, you are a citizen of where you are born. My friend is an American ( born and raised). She lived in Mexico for several years, and durign that time she had a daughter, who is Mexican because she was born there.

Yes, she was *from* Kansas, living in Hawaii and gave birth at 18 from what has been widely disseminated.

What has been posted elsewhere... again I am no immigration lawyer... and I am sure this is just getting steam right now... is that the law is if one parent was not a citizen the the other would have to resided in the US for at least five years *after* turning 16 years of age for the child to be born American... else the child would be a naturalized citizen, yes... but naturalized citizens are ineligible to be President. Think of Arnold. Great politician... naturalized citizen. Technicality yes,*if* it holds true it will be interesting. Again, I have just read it and am nobody's expert on immigration law.

I am not sure about the 16 year old part. Maybe an immigration lawyer could input here. That is the important catch, if there *is* a catch. But yes, if it is true, then how indeed.

I am wondering aloud if back months ago... I think I remember somebody was trying to access his passport records. You need a birth certificate to get a passport. I am wondering if this was not the target of the search and *not* the travel history.

What do you mean "allowed to run"? Anyone who can get on the ballot is "allowed to run", there is no government panel vetting who can run and who cannot.

Again, I am no lawyer but... the above link cut off some here is a clip from page 2 of it...

***Begin Findlaw excerpt***

"If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16. There are no conditions placed on retaining this type of citizenship. If your one U.S. citizen parent is your father and you were born outside of marriage, the same rules apply if your father legally legitimated you before your 21st birthday and you were unmarried at the time. If legitimation occurred after November 14, 1986, your father must have established paternity prior to your 18th birthday, either by acknowledgment or by court order, and must have stated in writing that he would support you financially until your 18th birthday."

Again, Justice...peace to everybody here. *If* it turned out he was ineligible... then it *should* come out. Again, I am no lawyer, but reading it... I would feel better knowing somebody who does know has checked through it. That's all.
